This Privacy Policy explains how Superluxe Merch collects, uses and shares personal information when you visit superluxemerch.com, request a quote, place an order, chat, text or email with us, or otherwise work with us. Superluxe Merch is operated by Phx Screen Print LLC, an Arizona limited liability company (“Superluxe Merch,” “we,” “us” or “our”), headquartered in Phoenix, Arizona.

The basics

What this policy covers

This policy covers our website and online store, our quote, order and artwork forms, emails, the chat window on our site, order text messages, and orders you place with us by phone or in person. “Personal information” means information that identifies you or can reasonably be linked to you. It doesn’t include information that has been de-identified or aggregated so it can’t be linked to you.

We collect what we need to quote, proof, make, ship and support your order, and to run and improve our site. We share it with the service providers that help us do that. We use or may use advertising cookies from Google to measure our ads and show them to people who have visited our site. You can opt out of that at any time, and you can contact hello@superluxemerch.com to ask what we have, fix it or delete it.

What we collect

Information you give us

  • Contact details: name, company or organization, email address, phone number, and shipping and billing addresses.
  • Quote and order details: products, quantities, sizes, colors, deadlines, budgets, delivery instructions and notes.
  • Artwork and files: logos, designs, photos and instructions you upload or email to us, and photos you send us of an issue with an order.
  • Account details: if you create a customer account on our store, your login details and order history.
  • Payment details: payments are handled by our payment processors: Shopify Payments for online store checkout, and QuickBooks (Intuit) for custom-order invoices. We receive payment confirmations and limited details such as card type, but we don’t store full payment card numbers.
  • Communications: the content of emails, chat messages, texts and calls with us.
  • Mobile number and text consent: if you opt in to order texts, your mobile number and a record of your consent.
  • Recipient lists: if you use our fulfillment services, the names and shipping addresses of the people you ask us to ship to.
  • Job applications: if you apply to work with us, the information in your application.

Information collected automatically

When you use our site, we and our service providers use cookies, pixels and similar technologies to collect device and usage information: browser and device type, IP address, approximate location based on your IP address, pages you view, links you click, the site that referred you, and the date and time of your visit.

If you arrive from an ad or a tagged link, our site saves the campaign details (such as UTM tags and Google click IDs) in a first-party cookie and in your browser’s local storage for up to 90 days, so we can see which campaigns lead to quote requests.

We use or may use advertising cookies, pixels and tags from Google (Google Ads and Google Analytics) that collect similar information to measure our ads and for remarketing. See “Advertising, remarketing and sharing” below.

Information from other sources

  • Service providers, such as payment confirmations from payment processors and delivery updates from shipping carriers.
  • Organizations that order for you. A company, church, school or team may give us your name, size or shipping address so we can make or ship their order.
  • Business contact sources. We may get business contact information (such as name, job title, company and work email) from public or commercially available business sources to contact organizations about our services.

  • Quote, order and artwork forms on our site, including file uploads.
  • Checkout and customer accounts on our online store.
  • Email, chat, text and phone conversations with our team.
  • Cookies, analytics and advertising tags on our site (see “Cookies, analytics and tracking” below).

How we use it

How we use your information

  • To prepare quotes and proofs, produce and decorate your order, and pack, ship or fulfill it.
  • To communicate with you about quotes, proofs, orders and support, including order texts if you opt in.
  • To process payments and prevent fraud, spam and abuse (for example, spam protection on our forms).
  • To run, secure and improve our site and services, including understanding how visitors use the site.
  • To measure how our ads perform and to show our ads to people who have visited our site (remarketing), unless you opt out.
  • To send emails about our services, such as our newsletter if you sign up. You can unsubscribe at any time.
  • To review job applications.
  • To meet legal, tax and accounting obligations, resolve disputes and enforce our Terms of Service.

Your artwork

We use the artwork and files you send us only to quote, proof, produce and deliver your orders and to keep a record of your order history. We don’t sell or license your artwork to anyone. As our Print Policies explain, we sometimes photograph finished orders to share our work. If you’d rather we didn’t, tell us when you order.

How we share it

Service providers we use

We share personal information with service providers that help us run our business. They may use it only to provide services to us. They include:

  • Shopify, which hosts our website and online store, checkout, customer accounts, contact forms and store analytics. Shopify’s form spam protection may use Google reCAPTCHA or hCaptcha.
  • Google: Google Workspace for business email and files, and Google Analytics to understand how visitors use our site. Google’s advertising tools are covered in “Advertising, remarketing and sharing” below.
  • Resend, which delivers emails such as quote confirmations, proofs and order updates.
  • Twilio, which delivers order text messages if you opt in.
  • Trello, which we use to manage orders, proofs and production status.
  • Uploadcare, which receives the artwork files you upload through our forms.
  • Tidio, which powers the chat window on our site.
  • Render, which hosts our quote, proof and order tools.
  • Shopify Payments, which processes payments at our online store checkout, and QuickBooks (Intuit), which we use to send and collect payment on custom-order invoices.
  • Shipping carriers, and the vendors that help decorate and produce your order, which receive only the artwork and order details they need.

Other times we share information

  • With your direction or consent, for example when you ask us to ship to someone or to send proofs to your team.
  • For legal reasons: to comply with law or valid legal process, to protect the rights, safety and property of our customers, our team or others, and to enforce our terms.
  • In a business transfer, such as a merger, sale of assets or reorganization, subject to this policy.

Shopify's own use of information

Shopify also processes some information as an independent business, for example to run Shop Pay and the Shop app. That use is covered by the Shopify Consumer Privacy Policy, and you can make requests about it through the Shopify Privacy Portal.

Advertising, remarketing and sharing

We use or may use Google Ads and Google Analytics cookies, pixels and tags on our site to measure how our ads perform (for example, whether someone who clicked one of our ads later requested a quote) and to show our ads to people who have visited our site while they browse other sites and apps (remarketing). These tools let Google collect information such as your IP address, cookie and device identifiers, browser type, the pages you view and the actions you take on our site. Google uses that information under its own privacy policy and may combine it with information from other sites and services; see how Google uses information from sites that use its services.

Under the California Consumer Privacy Act, letting an advertising company collect this information for ads based on your activity across other companies’ sites and apps (“cross-context behavioral advertising”) may count as “sharing” your personal information. Under some other state privacy laws, it may count as “targeted advertising” or a “sale.” We don’t sell personal information for money. You can opt out at any time, as explained in “Do Not Sell or Share My Personal Information” below. We do not knowingly sell or share the personal information of anyone under 16.

Do Not Sell or Share My Personal Information

You can opt out of the sale or sharing of your personal information and of targeted advertising in any of these ways. You don’t need an account, and we won’t ask for more information than we need to carry out your request.

  • Global Privacy Control (GPC): turn on GPC in your browser or a browser extension. We treat a GPC signal as a valid opt-out request for that browser, and for your customer account if you’re signed in or we can otherwise link the browser to you.
  • Email us: send an email to hello@superluxemerch.com with “Do Not Sell or Share” in the subject line. If you’d like the opt-out to cover more than the browser you’re using, include the email address or phone number you’ve used with us.
  • Call us: call 480-248-3379 and tell us you want to opt out of the sale or sharing of your personal information.
  • Google’s ad settings: you can control the ads Google shows you in Google’s My Ad Center, and you can opt out of Google Analytics with Google’s browser add-on.

We act on opt-out requests as soon as we can, and no later than 15 business days after we receive them. Cookie-based choices apply to the browser and device you use, so you may need to opt out on each browser and device, and again if you clear your cookies. Opting out doesn’t stop all ads. You may still see ads from us that aren’t based on your activity on our site.

Cookies, analytics and your choices

Cookies, analytics and tracking

We use these kinds of cookies and similar technologies:

  • Essential: to run the cart, checkout and customer accounts, keep the site secure and protect our forms from spam.
  • Analytics: Google Analytics and Shopify’s analytics, to understand which pages people visit and how the site performs.
  • Functional: to run the chat window and remember your choices.
  • Campaign measurement: our own first-party cookie that remembers which ad or tagged link brought you to our site, for up to 90 days.
  • Advertising: Google Ads and Google Analytics cookies, pixels and tags we use or may use to measure our ads and for remarketing (see “Advertising, remarketing and sharing”).

Do Not Track and Global Privacy Control

Some browsers send a “Do Not Track” signal. There isn’t a common standard for how websites should respond to it, so our site doesn’t respond to Do Not Track signals.

We do recognize the Global Privacy Control (GPC). If your browser sends a GPC signal, we treat it as a request to opt out of the sale or sharing of your personal information and of targeted advertising, for that browser and, where we can link it to you, your customer account. That means we don’t use the advertising cookies and tags described above for remarketing or cross-context behavioral advertising in that browser.

Keeping your information safe

How long we keep information

We keep personal information only as long as we need it for the purposes in this policy. How long depends on why we have it: for example, how long we need it to complete and support your order and any reorders, to keep your account open, to keep required business, tax and accounting records, to show that you consented to texts, and to resolve disputes. When we no longer need it, we delete it or de-identify it.

How we protect information

We use reasonable administrative, technical and physical safeguards to protect personal information, and we limit access to the people and service providers who need it. No method of transmission or storage is completely secure, so we can’t guarantee absolute security. If a security breach affects your personal information, we will notify you as required by law.

Children

Our site and services are meant for adults and organizations. They are not directed to children under 13, and we do not knowingly collect personal information from children under 13. Orders for youth events and teams should be placed by an adult or organization. If you believe a child under 13 has given us personal information, email hello@superluxemerch.com and we will delete it.

Our text program is Superluxe Merch order notifications. If you opt in, for example by ticking the optional SMS box on our quote form, we use your mobile number only to send transactional texts about your own order: art-proof approval links, order status updates, and shipping or pickup updates. We do not send marketing or promotional texts through this program. Consent to texts is not a condition of purchase.

  • Message frequency varies by order.
  • Msg & data rates may apply.
  • Reply STOP to any message to opt out. We’ll send one text to confirm, then no more. Reply START to opt back in.
  • Reply HELP to any message for help, or email hello@superluxemerch.com.
  • Carriers are not liable for delayed or undelivered messages.

Mobile information is never shared for marketing

Mobile numbers and SMS opt-in consent are not shared with or sold to third parties or affiliates for marketing purposes. We share mobile numbers only with the service providers that deliver our texts (our SMS provider, Twilio, and wireless carriers), and only to send the messages you asked for. We don’t use mobile numbers collected for texts for advertising or upload them to advertising platforms. The sharing described elsewhere in this policy does not include text-messaging originator opt-in data or consent, which is not shared with any third party except to deliver our messages. This section applies notwithstanding anything else in this Privacy Policy.

Your privacy rights

Your privacy rights

Depending on where you live, you may have the right to:

  • Know and access the personal information we have about you, including the categories, sources, purposes and the categories of recipients.
  • Delete personal information we collected from you.
  • Correct inaccurate personal information.
  • Get a copy of your personal information in a portable format.
  • Opt out of the sale or sharing of personal information, targeted advertising and certain profiling. See Do Not Sell or Share My Personal Information.
  • Limit the use of sensitive personal information. We use sensitive information (such as account login details) only to provide the services you asked for.
  • Not be treated differently for using any of these rights.

We offer these choices to every customer where we reasonably can, wherever you live.

How to make a privacy request

Email hello@superluxemerch.com with “Privacy request” in the subject line, or call us at 480-248-3379. Tell us which right you want to use, and give us the name, email address or phone number you used with us so we can find your information. We will verify your request by matching the details you give us with our records, and we may ask for a little more information to confirm it’s you. We will confirm that we received your request within 10 business days and respond within 45 days. If we need more time (up to another 45 days), we’ll tell you why.

You can use an authorized agent to make a request for you. We will ask the agent for proof that you authorized them, and we may ask you to verify your identity with us directly.

Appeals. If we decline your request, you can appeal by replying to our decision or emailing us with “Privacy appeal” in the subject line. We will respond within the time the law requires. If you’re not satisfied with the outcome, you can contact your state attorney general.

California residents

The California Consumer Privacy Act, as amended by the California Privacy Rights Act, gives California residents the rights described above. In the past 12 months we have collected these categories of personal information, from the sources and for the purposes described in this policy:

  • Identifiers, such as name, email, phone number, postal address, IP address and account name.
  • Customer records described in Cal. Civ. Code § 1798.80(e), such as contact and payment details.
  • Commercial information, such as quotes, orders and purchase history.
  • Internet or other electronic network activity, such as pages viewed and interactions with our site.
  • Approximate geolocation, based on IP address.
  • Audio, electronic or visual information, such as artwork and photos you send us.
  • Professional or employment-related information, such as your organization and job title, and job applications.
  • Sensitive personal information, limited to account login details.

We disclose each of these categories for business purposes to the service providers described in “Service providers we use.” Through the advertising cookies and tags described in “Advertising, remarketing and sharing,” we use or may use identifiers (such as cookie IDs and IP address), internet or other electronic network activity, and approximate geolocation in a way that may count as “sharing” with Google for cross-context behavioral advertising. You can opt out as described in Do Not Sell or Share My Personal Information. We don’t sell personal information for money, and we do not use sensitive personal information to infer characteristics about you.

Shine the Light. We don’t disclose personal information to third parties for their own direct marketing purposes.

Residents of other states

Several other states, including Colorado, Connecticut, Oregon, Texas and Virginia, have consumer privacy laws that give residents rights like the ones above, such as access, correction, deletion, portability and opting out of targeted advertising, sale and certain profiling, plus the right to appeal our decision. You can use those rights the same way, by emailing us, and you can opt out of targeted advertising and sale using Global Privacy Control or the other methods in “Do Not Sell or Share My Personal Information.” Arizona, where we are headquartered, does not currently have a general consumer privacy law, but we follow this policy for Arizona customers too.

Other things to know

Emails from us

We send transactional emails about your quotes, proofs and orders. If you sign up for our newsletter or we contact your organization about our services, every marketing email includes an unsubscribe link, and we honor unsubscribe requests promptly. You’ll still get transactional emails about orders you place.

Where we process information

We are based in the United States, and we and our service providers process and store information in the United States and other countries where they operate. If you contact us from outside the United States, your information will be transferred to the United States.

Changes to this policy

We may update this policy from time to time. When we do, we’ll post the new version here and change the effective date at the top. If we make a material change, we’ll give you notice as required by law.
